TURKPATENT – Updated Trademark Examination Guidelines


A new updated version of Trademark Examination Guidelines concerning the proceedings before the Turkish Patent and Trademark Office was published on August 18th, 2021.


This update was drawn up to clarify the examination principles under Article 6 of the Turkish IP Law No. 6769 “relative grounds for rejection of trademark registration”, and thus to maximize the compliance of the Office decisions regarding trademark prosecution.


Particularly “likelihood of confusion” is assessed in the updated sections so as to clarify the basic approaches of the Office in the evaluation of goods/service similarity and sign similarity, and the basic factors affecting the likelihood of confusion were explained in detail with examples.


The earlier updated version of the Guidelines on 30-Sep-2019 was directed to clarify the examination principles under Article 5 of the Turkish IP Law No. 6769 “absolute grounds for rejection of trademark registration”.
